BALLARAT’S BIG BITE PARTICIPANT RELEASE TERMS AND CONDITIONS 
Graffiti Group Pty Ltd (ABN 44 110 497 786) of Level 3, 105 &#8211; 115 Dover St, Cremorne VIC 3121 is organising the ‘Ballarat’s Big Bite’ unofficial world record attempt activation (the “Activity”) on behalf of Ballarat City Council (ABN 37 601 599 422) of The Phoenix Building, 25 Armstrong Street, South Ballarat VIC 3350 (“Sponsor”), collectively, the “Organisers”. You have agreed to participate in the Activity and do so at your own risk. During the Activity, the Organisers will be producing video footage and/or photographs for the marketing, publicity and promotion of the Sponsors’ products and services including Ballarat’s annual Best Pie Competition (the “Marketing Material”) including live broadcast on Channel 7’s ‘Sunrise’ program.
By checking the box when booking a ticket to the Activity, you agree to participate in the Activity on these terms and conditions (the “Terms”) and you agree and warrant that: (i) you are aged 18 or over, or you are the parent/guardian of a participant and you are agree to these Terms on their behalf; 
(ii) the Terms apply to any minors that accompany you during the Activity, you agree to remain responsible for the same, and you consent for any such minors to participate in the Activity at their and your own risk; and (iii) the declarations below are true and accurate in all respects.
By checking the box when booking a ticket to the Activity and participating in the Activity you agree and declare as follows: 
1. I declare that I have not been informed by any physician or health professional, and I know of no restriction, allergy, disease or condition that would in any way prevent me from actively participating in the Activity or present a risk to my health should I do so. Specifically, I agree that I do not have any allergy, intolerance or dietary requirement that would prevent me from eating a meat pie, which will or may contain beef mincemeat, flour, wheat, soy, 
gluten, sulphites, egg, onion, garlic, pepper or baking powder. I acknowledge and agree that: 
(i) only one type of pie (standard meat) will be made for the Activity; 
(ii) allergies, intolerances or dietary requirements cannot be accommodated for by the Organisers (such as halal, kosher, vegetarian, vegan, dairy-free, gluten-free/coeliac-friendly options); 
(iii) if I suffer from allergies, intolerances or dietary requirements, I will not eat the pie, I will remove myself from the Activity space and notify Activity staff.
2. I understand that the Activity will be broadcast live on television and other media platforms (including online) and I agree to grant to the Organisers, their agents, employees, licensees, and successors and assigns the following: 
(a) The right to use my name, voice, spoken word, performance, photograph, image, silhouette or other reproduction by photography, film, or otherwise (my “Likeness”) in connection with the Marketing Material; and 
(b) All rights of every nature whatsoever in connection with the use of my Likeness in the Marketing Material, including without limitation all copyrights therein, and the exclusive right to reproduce, exhibit, distribute, edit, modify and otherwise exploit my Likeness in the Marketing Material, in whole or in part, forever throughout the world in any and all media (including television, online or any other media), whether existing now or in future, including without limitation in, and in connection with, the marketing, publicity and promotion of the Sponsors’ products and services. I also agree that the Organisers may edit, alter, reproduce or otherwise change the Marketing Material in whole or in part.
3. I warrant that there is no existing restriction or obligation which would prevent the use of my Likeness in the Marketing Material or prevent me from agreeing to these Terms.
4. To the maximum extent permitted by law: 
(a) I hereby agree to indemnify the Organisers and their related bodies corporate, and their 
officers, directors, employees and agents against all liability, claims or proceedings 
whatsoever; and 
(b) I hereby agree the Organisers and their related bodies corporate, officers, directors, employees and agents will be released from any and all claims, demands, actions or causes of action of any kind and will be held harmless for any loss or damage (including but not limited to injury, illness, death, loss of property or breach of any rights including publicity, privacy, moral rights or defamation) howsoever caused, which I or any of my successors or assigns may now, or at any time, have or claim to have or suffer, whatsoever arising from or connected with my participation in the Activity, or the filming, recording, broadcasting, distribution, exhibition, advertising, or other exploitation of my Likeness, including but not limited to as a result of: 
(i) my negligence; 
(ii) any failure by me to follow a reasonable directive or instruction by the Organisers or Activity 
staff; 
(iii) any failure by me to identify any allergy, intolerance or dietary requirement; or 
(iv) any breach by me of, or non-compliance by me with, these Terms; and
5. These Terms shall operate for the benefit of, and shall be binding upon, our respective successors, licensees, assigns, heirs and personal representatives. The Organisers shall not be obligated to use any of the rights granted by me or use my name within the Marketing Material, and I acknowledge that the Organisers will have complete artistic and creative freedom and discretion. All determinations made by the Organisers in this regard shall be final.
6. I acknowledge that participation in the Activity shall be subject to, and constitute acceptance of, the following terms and conditions: 
(a) I understand the nature of the Activity and what is involved and acknowledge that there is a risk of choking, burns, allergic reaction or anaphylaxis resulting in illness, injury or death to myself and others by virtue of my participation and I participate in the Activity at my own risk; 
(b) I agree that when directed, I will actively take a bite of the pie given to me by Activity staff, noting the Activity involves a record attempt for the most people eating pie simultaneously; 
(c) While all care is taken, the Organisers accept no responsibility for any injuries beyond what is required by law; 
(d) I agree not to engage in any unsafe, antisocial or dangerous behaviour and agree to act appropriately for the entirety of the Activity; 
(e) If the Organisers view any action/behaviour as unsuitable, the Organisers (or Activity staff) 
reserve the right to, in their absolute discretion, remove me immediately from the Activity space. Activity staff retain the right to refuse entry if they feel safety is at risk; 
(f) I must comply with all directions and instruction from the Organisers or Activity staff while in the vicinity of or engaging in the Activity, including those which may be posted on-site; 
(g) It is my responsibility to notify Activity staff if I am experiencing negative effects while participating in the Activity; and 
(h) I acknowledge that the Activity is drug and alcohol free, and agree that I will not consume or 
be under the influence of any drugs or alcohol products while participating in the Activity.
