GENERAL COMPETITION - Terms and Conditions of entry
These General Competition Terms and Conditions apply to all competitions run by the Promoter. They may be amended or varied from time to time by the Promoter. Special Terms and Conditions may apply to particular contests in which case, the Special Terms and Conditions will be highlighted on the competition/promotion page.

2. WHO MAY ENTER
2.1 Any general person above the age of 18 may enter and be awarded prizes.
2.2 Employees of the Promoter or its related bodies corporate, or the immediate family of such employees are not eligible to enter or be awarded prizes. "Immediate family" means spouse, parent, child or sibling, whether or not they live in the same household as the employee.
3. CONDITIONS OF ENTRY
By entering the competition, participants agree to be bound by these General Terms and Conditions and any Special Terms and Conditions appearing on the website specific to the particular competition.
3.1 Unless otherwise specified, no person may enter a competition more than once.
3.3 All entries answers must be received by the closing date specified in the competition.

4.1 The competition will run between Tuesday 24 Jan until Tuesday 31 Jan 2017.
5. LIMITATIONS ON ENTRY
5.1 Participants may only enter the competition once.
6. HOW TO ENTER AND SELECTION OF WINNERS
At the end of the promotional period, winners for the prize will be drawn at random by the Promoter. Winners will be contacted via email or telephone with further details, and must present their personal contact details upon request.
The Promoter's decision in relation to any aspect of the competition is final and binding on every entrant. No correspondence will be entered into.
7.1 All prizes must be taken as offered and are not exchangeable, transferable, redeemable for cash or for resale. In the event that a prize is unavailable, the Promoter reserves the right to substitute a prize of equal or greater value. Prizes unclaimed after a period of one week from the date of notification of the winner may be forfeited and used by the Promoter at the discretion of the Promoter.
7.2 Prize collection method: The voucher must be claimed in person from Ballarat Regional Tourism, 225 Sturt Street, Ballarat, unless the winner is otherwise advised. Photographic identification of the winner will be required (examples include drivers license/passport/student card where photo included) to claim a prize.
7.3 In special situations, and subject to the absolute discretion of the Promoter, a winner may nominate a designated representative to collect a prize. The representative will be required to present written authorisation from the winner and photographic identification of both the winner and their representative.
7.4 Where a winner chooses not to accept a prize, they forfeit any and all claims to that prize, which will be dealt with at the absolute discretion of the Promoter.
7.5 If the winner(s) of the prize cannot be traced after all reasonable efforts having been made by the Promoter, then the Promoter may dispose of the prize as it thinks fit without any liability to the winner(s) for having done so.
8.1 All entries become the property of the Promoter. Entries not completed in accordance with the conditions of entry or received after the closing date will not be considered. Indecipherable or incomplete entries will be disregarded.
8.2 Entrants are liable for their costs to access telephone, mobile or computer networks.
The personal information collected as part of the entry is collected to enable identification of the winner and for future marketing and promotional purposes. Your personal information will only be disclosed to the Promoter and its related bodies corporate for these purposes. By entering you are agreeing to sign up to the Visit Ballarat newsletter.
10. LIMITATION OF LIABILITY
10.1 The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again.
10.2 The Promoter shall have no liability in respect of competitions operated on behalf of third parties (for example, sponsors) except in respect of death or personal injury directly attributable to the Promoter’s negligence.
10.3 The Promoter accepts no liability (and excludes all liability) for any loss of profit, business, contracts, revenues or anticipated savings or for any special, direct, indirect or consequential loss of any nature howsoever arising.
10.4 The Promoter shall not be liable to perform any of its obligations under the competition or in respect of the prizes where it is unable to do so as a result of circumstances beyond its control and shall not be liable to compensate you in such circumstances.
11. Health and safety
11.1 You must take all reasonable steps to ensure your own health and safety. Any conduct or behaviour, act or conduct by you that the Promoter considers to pose any medical, security or safety risk will lead to your immediate disqualification (including without limitation, any abusive behaviour, physical or verbal).
11.2 All activities are undertaken at your own risk. You must notify the Promoter of any medical or other condition which may mean that you are unfit for travel or participation in the Contest as soon as you become aware of such a condition. The Promoter reserves the right to forfeit your place in the Contest or the Prize (without liability or compensation) if, in its opinion, you may expose yourself or others to risk of illness or injury, or to the cancellation, disruption or curtailment of the contest.
12.1 Competitors may be required by the Promoter to participate in a photo, video and/or film session, and acknowledge that the Promoter has the right to use such publicity photos, videos and/or films or publish the name and suburb of the competition winner in any medium and in any reasonable manner it sees fit, unless that person informs the Promoter at the time of entering the competition that he or she wishes to retain his or her anonymity.
12.2 Contest entries and material submitted in connection with any contest (whether in written, audio, electronic or visual form, or any combination of those) or any photographs, video and/or film footage and/or audio recording taken of competitors become the property of the Promoter, which may use the material in any medium and in any reasonable manner it sees fit. Copyright in any such material remains the sole property of the Promoter.
12.3 The Promoter may publicise, broadcast or otherwise disclose a competitor's name, character, likeness, statements or any recording of his or her voice in advertising or promotional activities concerning a specific contest, or the Promoter contests generally. The Promoter may promote or advertise that a winner has won a contest.
12.4 The Promoter may incorporate information from entrants in any contest in any database to be used for the purpose of its business. Upon entry into a competition a contestant will automatically give permission for use of personal data and this information will be retained in accordance with the Data Protection Act.
13.1 These rules shall be governed and construed in accordance with English Law.
13.2 Where the Promoter has special contest Terms and Conditions in relation to a particular contest, then they (the special terms and conditions) will prevail in the event of inconsistency between those special contest Terms and Conditions and these General Contest Rules.
13.3 Persons under the age of 18 are eligible to enter the contest.
13.4 A failure by the Promoter to enforce any of these contest rules in any instance(s) will not give rise to any claim by any individual.
13.5 Special restrictions or qualifications may apply to particular contests, in which case an addendum to these General Contest Terms and Conditions will be made.
13.6 The Promoter may change these General Contest Terms and Conditions at any time.
